Abstract

The military justice system in Indonesia is part of the law enforcement mechanism aimed at maintaining discipline, professionalism, and order within the Indonesian National Armed Forces (TNI). However, in practice, the existence of military courts often raises debates regarding independence, transparency, and their conformity with the principles of the rule of law and constitutional supremacy. This study aims to analyze the ideality of the military justice system in Indonesia from the perspective of the rule of law and constitutional supremacy, as well as to examine the challenges in realizing a fair and accountable judicial system. The research method used is normative legal research with statutory and conceptual approaches. Data sources were obtained through library research on legislation, scientific literature, journals, and relevant legal documents. The results of the study indicate that the military justice system fundamentally possesses constitutional legitimacy as a special court; however, it still faces various issues, such as limited transparency, potential institutional conflicts of interest, and the suboptimal implementation of the principle of equality before the law. From the perspective of the rule of law, reform of the military justice system is necessary to strengthen judicial independence, improve accountability, and ensure the protection of human rights. Therefore, the ideality of the military justice system can be achieved through harmonization between the interests of military discipline and the principle of constitutional supremacy within the national legal system.
