Ketidaksesuaian Sistem Peradilan Militer di Indonesia: Analisis Prosedural, Substansial, dan Dampaknya Terhadap Keadilan Publik

The military justice system in Indonesia continues to be the subject of intense debate concerning its procedural and substantive alignment with the general court system. This study aims to analyze the inconsistencies and effectiveness of the military justice system in Indonesia, as well as its impact on the resolution of cases involving military personnel and civilians. Employing a qualitative approach with a descriptive-analytical research design, data were collected through a review of literature and official documents published within the last ten years, selected using purposive sampling. The data were analyzed using thematic analysis. The findings reveal three main issues: (1) limited transparency and public access in military legal proceedings; (2) inconsistencies between the substantive legal provisions governing military justice and the general principles of justice; and (3) a tendency toward excessive institutional protection, which reinforces the perception of legal impunity for military personnel. This study concludes that these structural inconsistencies hinder the realization of equal justice under the principle of equality before the law. Therefore, comprehensive reform of the military justice system is urgently required.
